GENERAL SALES CONDITIONS FOR PRIVATE USE

  1. AREA OF APPLICATION

    These general sales conditions rule GP Pays Basque's sales concerning www.maison-inona.com web site.

  2. OFFERS

    All the offers are available during the duration of the publication in the web site.
    The photos on the web site are non-contractual.

    1. Disponibility

      All the products are renowned available. If goods are not available, the word "out of stock" will appear in the field “quantity”.

    2. Prices

      Prices are deemed to be in euros, TVA included and “ex-works”.
      All taxes and supplementary charges (customs clearance, banking charges) are to the purchaser's account.

  3. ORDERS

    Orders are placed directly on the web site. The validation of an order implies acceptance of these general sales conditions.
    An order is deemed to be validated when the payment has appeared in our banking account.
    An ordering confirmation is automatically sent by mail.
    Orders are treated everyday and sent as soon as possible.

  4. COOLING-OFF RIGHT

    According to articles L.121.18 à L.121.20 of the Consumption Code, the purchaser can cancel his order at the latest 7 days after the date of delivering, without giving the reason why he wants to cancel it and without paying payment charges, except return shipping charges. If the order concerns perishable goods, the cooling-off right does not exist.

  5. DELIVERY

    Shipping charges are to the purchaser's account and paid when ordering.
    The method of delivery is chosen by the purchaser (the shipping charges are to his account). We advise a delivery by postal services (terms of delivery : 48 hours) for deliveries weighing less than 30kgs and by carrier for deliveries weighing more than 30kgs.
    Usually, terms of delivery are about 5 working days once the order is placed. These terms are available if there is no routing problems and depending on the availability of the goods.
    If there is a mistake on the delivering address, the seller is not responsible for the non-delivery.

  6. INVOICING

    The invoice is included in the box with the goods.

  7. PAYMENT

    There are two method of payment:
    • E.U.: Paypal or bank transfer
    • out of E.U. : Paypal
    For payment by bank transfer, the order will be sent when the amount will appear on the firm's bank account.

  8. PROPERTY RESERVATION

    Sales are conclued with property reservation. The transfer of ownership to the purchaser is subject to suspension pending receipt of the totality of the payment, by the agreed date and including any interest due.

  9. LITIGATIONS / COMPLAINTS

    If there is a bad delivery because of the transport, we advice the purchaser to write a letter to the carrier's firm and to send us a copy.
    If the delivery is not as per order because of a mistake we would have done, we advice the purchaser to send us a letter specifying the order number, the delivery date and explaining the reason why he disagrees. Preferably, litigations are settled amicably; otherwise, the competent court is the court of Bayonne.

      All the products are renowned available. If goods are not available, the word "out of stock" will appear in the field “quantity”.
      In order to guaranty a continuing supplying, without exhaustion of stock, we advise you to send us a previsional describing the products and the quantities you would need for a year.
      If we have a lower production than estimated, we would share it out according to the order you have sent to us. For example, if we harvest 10% of our production, we will send you 10% of the previsional you have given to us.

    2. Prices

      Prices are deemed to be in euros, free of taxes and “ex-works”.
      All taxes and supplementary charges (customs clearance, banking charges) are to the purchaser's account.

  3. ORDERS

    For following orders, the payment would be done:
    • E.U. : cash (by Paypal or bank transfer or within 30 days of invoicing by bank transfer
    • out of E.U. : cash by Paypal
    GP Pays-Basque could stop supplying until total price shall have been paid in full.
    According to Loi de Modernisation de l'Economie (LME), as from the 1st January 2009 the terms of payment will not exceed 60 days as from the date of invoicing. Late payment charges are set 1.5 times the amount of the invoice..
